Terms & Conditions Of Use
Accessing the pages within this site signifies your agreement with the following terms and conditions of use regarding this site and its content:

General
These conditions shall form part of all Contracts for the supply of goods by The Ceramic Store ( hereinafter called ' the company ' ), to any other person, firm or company ( hereinafter called ' the customer ') and shall prevail over any inconsistent terms of conditions contained or referred to in the Customer`s Order or in any correspondence or elsewhere and all or any conditions or stipulations contary to these are hereby excluded and extinguished.

No Employee has authority to vary or add or depart from these terms or make any representations about the goods or the contract made herein. Any failure by the Company to enforce any or all of the conditions above or below shall not be construed as a waiver of any of the Company`s rights hereunder. Should any term of this contract be held invalid, such invalidation shall not affect the validity of the remaining terms. Any typographical, clerical or other error or omission in any electronic communication, sales literature, quotation, price list, acceptance of offer, invoice or other document, communication or information issued by the Company shall be subject to correction without any liability on the part of the Company. Heading in these conditions are for reference purposes only and should not affect the interpretation of the conditions.

Orders & Confirmations
The placing of an order and entering into of an agreement by the customer is conditional on the customer being over 18 years of age. Quotations by the company shall not constitute offers by the company to supply goods or carry the work referred to therein. Orders placed will not be binding until accepted and confirmed by the Company by electronic mail and only when a charge has been made against the customers card. All such acceptances by the Company are subject to availability of the necessary materials and to the Company being able to obtain any necesary authorisation and / or licenses and to the same remaining valid.

The Company subject to prior sale accepts all Orders and prices of the goods shall be those ruling at the date of delivery. Any Value Added Tax payable in respect of the goods supplied under these conditions will be bourne by the customer. If the Company suffers any increased costs of virtue of a variation in the rates of exchange the Company and Customer hereunder shall renegociate the contract price of the undelivered goods.

The company reserves the right to decline any order.

Prices
Prices are displayed in Sterling (£) and are inclusive of VAT at the current rate. Prices displayed do not include delivery costs. Delivery costs are worked out as an average price because of weight variances.

Payment
Most major Credit and Debit Cards may be used to make payment. The customer will be asked to submit your card number and expiry date. Once your card is approved the company will send the customer an order confirmation e-mail.

The entry of credit card details is conducted on the web site through a secure payment provider (Protx).

Supply / Delivery
The time, if any, specified for the commencement and completion of the supply and delivery of the goods shall be deemed to be variable if delays are occasioned by force majeurs, strikes, lock-out, accidents or any reason whatsoever, and such times, if specified, are approximate only and not of contractual effect. Time of delivery is not of the essence of the contract nor shall the Company be under any liability in respect of any delay in delivery.

Most products (classic white, cream, black, crackles, metal knobs & handles) are normally despatched within 5 working days. Please note hand decorated and personalised products will possibly take longer.

Liability
Goods invoiced or supplied are not tested or sold as fit for any particular purpose and any term, warranty or condition express or implied or statutory to the contary is excluded. In no circumstances whatsoever shall the Company`s liability (in contract tort or otherwise) tot he Customer arising under, out of or in connection with this contract of the goods supplied hereunder exceed the invoice price of the particular goods or section of goods concerned.

All terms (express or implied) relating to the quality of goods are waranties only the breach of which gives no right to reject the goods or repudiate the contract in any circumstances whatsoever.

Notice of any claim arising out or in connection with this contract must be given in writing to the Company within 7 days from the date when the goods are delivered failing which all claims shall be deemed to be waived and absolutelty barred. In any event, the Company shall be under no liability for shortage or damage unless within 3 days of delivery the Customer gives written notice of claim to the carrier (otherwise than upon consignment note or delivery document) and the Company shall be under no liability whatsoever unless the customer can prove to the Companys satisfaction the identity of the goods complained of.

Force Majeurs
Should the Company be delayed in prevented from carrying out its obligations under the Contract by Act of God or riot, strike, lock ours, trade disputes or any other labour disturbances, fire, flood, difficulty in obtaining workmen, materials or transport or the consequences of hostilities of any government interference or other circumstances whatsoever outisde the Companys control and the Company shall not be liable to the buyer for any loss or damage whether direct or indirect which contract may thereby be suffered by the Customer and furthermore the Company shall be at liberty to determine or suspend the contract without incurring liabilty for any loss or damage resulting to the customer.

Cancellation & Returns
The customer has the right to return goods within 7 days of receipt (does not inlude personalised products). Goods shall not be returned without the Companys prior notification and arrangement.The customer may cancel orders without penalty prior to despatch ( does not include personalised products). After 7 days goods may only be returned if faulty. 

Any items returned that are not faulty will incur a 12.5% charge for re-stocking unless the return is as a result of our error.

Copyright
The contents of the Site, such as text, graphics, images, photographs, code and other date are protected by copyright, trade mark and other laws in both. The United Kingdom and Overseas. You may not copy, reproduce, display, publicity perform, distribute, transfer, sell or modify the date or otherwise use the data in any way for any public or commercial use. All Trademarks, service marks, and trade names are the property of the company or its suppliers.

In accordance with the companys privacy policy the company respects the customers privacy.

Proper Law
The contract between the company and the customer shall be governed by and interpreted in accordance with the laws of the United Kingdom.

Delivery Policy
A valid signature from your household will be required by a person 18 years or older. You will then become the owner of the items and The Ceramic Store will no longer be liable for their loss or destruction. Please check for damages before signing and then sign accordingly. If there are breakages and you signed "received in good condition" you lose your insurance cover. In all cases sign "Unchecked" if you do not have time to check immediately upon delivery.

Returns Policy
In order to return goods please contact us at theceramicstore@btconnect.com or telephone our helpline on (0121) 530 4600, quoting your order number.

We are happy to accept any product return (does not inlude personalised product) as long as it is in its original condition and packaging and is re-saleable. Replacement products will be charged (including delivery) until the returned product has been received in re-saleable condition. You will only be refunded your delivery cost if the return is as a result of our error (e.g faulty product, or incorrect shipment). Your statutory rights are not affected.
Any items returned that are not faulty will incur a 12.5% charge for re-stocking unless the return is as a result of our error.

Price Guarantee

Our promise to you is that if you find the same product somewhere else but would prefer to buy from us we will match the price providing we are sure the item is the same quality and not a cheaper alternative and that the product is currently in stock with both companies.
